Consequences of non-compliant Traffic Management Plans

A worker has been injured and a business prosecuted, as a result of their Traffic Management Plan not documenting designated exclusion zones separating forklifts and pedestrians.

The business had a traffic management plan that included a map of the workplace with arrows indicating the direction of truck movement, however, it contained no specifications in relation to powered mobile plant, including forklifts.

The Magistrate determined the business failed to eliminate or reduce the risk of powered mobile plant colliding with pedestrians at its workplace, and as such contravened the Occupational Health and Safety Act 2004The business was fined $40,000 and ordered to pay WorkSafe costs of $4,141.  They could have been fined a maximum of $75,000.
